Waiver & Release

In Consideration

In consideration of being allowed to participate or view in any way in the Nitro Sports Academy Program under the auspices of Nitro Sports Academy, I the undersigned participant(s) understand and agree that:

1. I RISK BODILY INJURY, INCLUDING PARALYSIS, DISMEMBERMENT, DISABILITY AND DEATH, and other particular rules of the sport, skills, equipment, and personal discipline may reduce the risk. THE RISK OF SERIOUS INJURY DOES EXIST, AS WELL AS THE RISK OF DAMAGE TO OR LOSS OF PROPERTY.
2. I KNOWINGLY AND FREELY ASSUME ANY AND ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERS and assume full responsibility for my participation.
3. I, FOR MYSELF, on behalf of my heirs, assigns, personal representatives and next of kin, hereby RELEASE, INDEMNIFY, HOLD HARMLESS AND PROMISE NOT TO SUE NITRO SPORTS ACADEMY, their officers, officials, volunteers, employees, sub-contractors, agents and/or assignees ("RELEASEES"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, AND/OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, EXCEPT THAT WHICH IS THE RESULT OF GROSS NEGLIGENCE OR WANTON MISCONDUCT, to the fullest extent permitted by law.

Commercial Property / Owner / Landlord

By signing this waiver of liability below, I fully understand that the property owner, Sligar Holdings LLC, will not be held liable for any and/or incidents by Nitro Sports Academy's customers outside its building. I agree that my son/daughter and all legal guardians entering Nitro Sports Academy's building will abide to these rules:

• ABSOLUTELY NO BALL PLAYING, HORSE PLAYING, OR RUNNING AROUND outside designated areas.
• NO ENTERING A CAGE, PITCHING, OR TRAINING AREA WITHOUT PERMISSION.
• LITTERING WILL BE PROHIBITED on the owner premises — including sidewalks, parking areas, parking lot, and all common areas.

Any damages caused by you or your party will be your responsibility, and compensation will be made to said ownership.

Authorization — Use of Likeness

Participants, or their legal guardians, in Nitro Sports Academy events may be recorded and photographed by owner, trainers, and advertisers of Nitro Sports Academy. Participants or legal guardians hereby give Nitro Sports Academy the right to use their name, picture, and likeness without any right of approval to promote Nitro Sports Academy events.

For Parents / Guardians of Participants of Minority Age

Under Age 18 (or under such other age of consent as may be applicable in any given jurisdiction) at time of registration.

This is to certify that I/we, as parent(s)/guardian(s) with legal responsibility for this participant(s), do consent and agree not only to the release above regarding this participant's participation in any Nitro Sports Academy event, but also for myself/ourselves, and my/our heirs, assigns and next of kin, to release and indemnify the Releasees from any and all injury/incident to my/our minor participant(s), as stated above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law. As parent(s)/legal guardian(s) for this participant, I/we also hereby give Nitro Sports Academy the right to use the name, film, photograph, and/or likeness (without any right of approval) of this participant for any use to promote Nitro Sports Academy events and its activities.
